While we have business hours Monday–Friday from 9AM until 5PM, we realize that scheduling an appointment during those times is are not always convenient. Please call our office and we will do our best to accommodate your scheduling needs.
I was involved in a work accident that I caused and now I have medical bills as a result of my injury. Do I have any workers compensation rights?
Yes, you may. Under Tennessee workers compensation laws, it does not matter who caused the accident if you are injured on the job, as long as the accident did not result from alcohol, drugs, or horseplay.
Is there a monetary limit when filing a workers compensation claim?
Yes. In 2009, Tennessee laws changed. Specifically, compensation is limited in workers compensation cases if the employee returns to work with the pre-injury employer at the same rate of pay. However, the employee can re-open the case for more money if they lose their job within a certain amount of time from the settlement. To do so, you must file the claim for reconsideration within one year after the loss of employment.
Can I be fired for filing a workers compensation claim in Tennessee?
No. Termination for reporting a work-related injury in Tennessee is illegal. If an employee is terminated because of filing a workers compensation claim, the employer is subjected to a much larger lawsuit called retaliatory discharge. Damages that an employee may recover in a retaliatory discharge lawsuit are: job reinstatement, past lost wages, future lost wages, any humiliation, mental anguish, and punitive damages. It is important to hire an experienced attorney to handle your workers compensation issues.
I was involved in an auto accident and the other driver offered me money on the spot. I refused to take it. Was I wrong to deny the monetary offer?
You were right to deny the monetary offer. By accepting money, you may give up your right and the insurance company's right to file a claim against the other driver, even if the damages turn out to be more extensive than you first thought.
Do I really need an attorney to handle my auto accident claim?
The more extensive the damages or injuries in the accident, the more important it is to hire an experienced attorney to handle your case. If you have bodily injury, damage to your automobile, medical bills, and/or lost wages, it is the wisest choice to hire a lawyer to help you with your case.
