Understanding Tennessee Workers Comp Laws

As the industrial revolution began and more employees were hurt in work-related accidents, the federal government saw a need for employees to be compensated for any injury they receive on the job.  That need gave birth to the first workers compensation laws in Maryland in 1902.

Today, every state has it own workers comp laws.  Even with Jackson workers compensation laws, there are still plenty of gray areas open to interpretation.  Shedding light on those gray areas is one way I can help you.  I am Sherry House-Percival, a caring and experienced attorney at Percival Law Offices in Jackson, TN.

Understanding workers comp law

Under Jackson workers comp law, you can receive compensation for all medical expenses and lost wages for any injuries or illnesses you receive on the job and your family can receive death benefits if you are killed on the job.   In exchange for these benefits, you forfeit your right to sue your employer for negligence, wrongful death, or other liability in the accident.

If you are injured on the job, your employer must provide you with a list of physicians who are pre-approved to treat your condition.  Although there is an initial waiting period of seven days, if your disability continues for 14 days or more, you can receive retroactive compensation from the date of your injury.

Jackson workers compensation laws are compulsory.  Any business with five employees or more and all construction employers and subcontractors must carry workers comp insurance, even if the construction business has fewer than five employees.
